This suit was commenced on the 6th day of September, 1849, on a promissory note made by the defendants, together with Thomas J. Lacy, and G. N. Causin, dated 24th February, 1843, and payable to the plain tiff one year after date. It will be necessary to state only so much of the pleadings and evidence as will show distinctly the questions presented on the record.
