This action is in this court by ap-. peal, and is submitted on a transcript of the evP dence offered in the court of common pleas, supplemented by some additional testimony. It is an action under favor of Section 10857, General Code, brought by C. B. McCoy, as executor of the will of Charles F. Gosser, deceased, asking the direction of the court in the administration of the estate of said decedent. A number of questions *146are presented by the petition, relative to which plaintiff is in doubt as to his duties.
