MONTEITH, Chief Justice.
This is an appeal from an order overruling a plea of privilege in an action brought by appellee, W. B. Barbee, in the district court of Wharton County, seeking *371recovery of damages to a Hudson' automobile under a Texas standard automobile policy of insurance issued by appellant, the Home Insurance Company, New York.
Appellant filed its plea of privilege to have the suit tried in Harris County, the residence of its alleged duly authorized “agent for service”. It denied under oath that it maintained any other “agent for service under the laws of Texas, in Wharton County,…
