Tbe appellee, Louisville Deutsche Scheutzen G-esselschoft, as plaintiff in the 'Court below, filed this action in *190the Jefferson circuit court against appellant, Joseph Holzkneeht, and three others as defendants seeking to recover from them the amount of a note alleged to have been executed by them to plaintiff on January 3, 1915, whereby they agreed to pay it one year thereafter the sum of $300.00.'
