We copy from appellant’s brief the following statement of the case as substantially correct:
“This suit was brought by Farmers’ & Mechanics’ National Bank of Fort Worth, Tex., in the Sixty-Seventh district court, Tarrant county, Tex., against Union Oil Production Company, a corporation, J. W. Head, A. H. Kirby, and Chas. T. Ball to recover upon a promissory note in the principal sum of $5,000, and to foreclose a chattel mortgage given to secure said note.
