Appeal from a judgment of the General Term of the City Court of New York affirming a judgment of that court entered upon the verdict of a jury for plaintiff, upon his consent to a reduction of the amount of the verdict. The facts are stated in the opinion.

Allen, J. —
This is an appeal from a judgment of the General Term of the City Court affirming a judgment entered upon the verdict of a jury, upon reducing the same $23.
The action was brought upon an undertaking on attachment for $250 executed by the defendants as sureties, which attachment had been vacated. The damages sought to be recovered in said suit were counsel fees incurred by the. plaintiff in the attachment proceedings. The plaintiff was given a verdict of $200, and a judgment was entered thereon, which was modified and affirmed by the General Term of the City Court.
