Grimson, District Judge.

The plaintiff is a citizen and taxpayer of -the City of Dickinson, North Dakota, and brings this action on behalf of himself and all other citizens and taxpayers of the City of Dickinson similarly situated to enjoin the City of Dickinson and its Board of City Commissioners from entering into a proposed contract with the United States for a supply of water for the City. The trial court granted the prayer of the plaintiff and enjoined the City from entering into said proposed contract. The defendants appeal from the judgment.
