— The writ of error brings for review a judgment in favor of the plaintiff in distress proceedings. The same parties who are parties to this action were before this Court in the case of Tampa Drug Co., et al., v. West Drug Stores, Inc., 112 Fla. 331, 150 Sou. 786. In that case we construed the contracts between the parties and determined the status to the effect that West Drug Stores, Inc., being the assignee of the lease held by Plillsborough Pharmacy, Inc., by virtue of purchase at bankruptcy sale of the assets of Hillsboro Pharmacy, Inc., was a lessee from month to month.
