*1003In an action to recover damages for breach of express and implied warranties, the plaintiff appeals from an order of the Supreme Court, Suffolk County (Pitts, J.), dated January 5, 2007, which granted the defendant’s motion for summary judgment dismissing the complaint and denied his cross motion, inter alia, for leave to serve an amended complaint.
Ordered that the order is affirmed, with costs.
