The Pennsylvania Department of Transportation (DOT) appeals from an order of the Court of Common Pleas of Monroe County (trial court) sustaining the appeal of the suspension of the driver’s license of Zszislaw Warenezuk (licensee) for one year pursuant *1226to Section 1547 of the Vehicle Code 1 The order of the Court of Common Pleas is reversed.
On May 24,1990, the licensee was arrested and charged with driving under the influence. Upon the licensee’s failure to complete the breathalyzer test, a report of refusal was forwarded to DOT. DOT subsequently suspended the licensee’s…
