BATTISTI, Chief Judge.
Petitioner seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Respondent has filed a motion to dismiss the amended petition for failure to exhaust state remedies as required by 28 U.S.C. § 2254(b) and (c).
Petitioner was indicted for the crimes of possession of cocaine for sale and the sale of a narcotic drug. He was represented by counsel at trial and the jury returned a verdict of guilty on both counts of the indictment.
