This was an action instituted by some of the. appellants herein to declare illegal, null, and void, and to set aside the sewer assessment lien on real estate lying within the district of the “Thirtieth .Street and Hillside Main Sanitary Sewer” in Indianapolis, which lien was fixed by the board of public works of said city, to secure payment of part of the cost of. the construction of said sewer. The other appellants thereafter instituted a similar action as to said sewer, assessment lien insofar as it affected real estate owned by them. The two actions were consolidated.
