This proceeding came on for hearing on cross-motions for summary judgment. Larry B. Ricke appeared for the plaintiff. Robert C. Maki appeared for defendant City of Duluth. Matthew L. Fling appeared for defendants Fitger’s Inn Limited Partnership (FILP) and Fitger’s Inn Management Company (FIMC).
