Appeal from a judgment of the Supreme Court (Bradley, J.), entered April 28, 2004 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of the Board of Parole denying petitioner’s request for parole release.

Petitioner is serving a sentence of 15 years to life following his 1979 conviction of murder in the second degree (two counts) after he shot two women to death during a robbery. Petitioner made his sixth appearance before the Board of Parole on June 10, 2003 and his request for parole release was again denied.…
