The several assignments of error challenge the overruling of plaintiff’s demurrer to defendant’s special plea, and the sustaining of defendant’s demurrer to plaintiff’s replications from 1 to 10, inclusive.
The facts averred in the pleadings are that on or about October 25, 1911, the plaintiff, Bishop, a minor, while working for the defendant, Big Sandy Lumber Company, sustained a personal injury; that on November 21, 1911, one Mills was by the probate court of Tuscaloosa county duly appointed guardian for said minor; that said guardian effected a compromise of the ward’s claim against the…
