In this babeas corpus proceeding instituted in the Circuit Court of Marshall County, the petitioner, William Shears, seeks a writ to compel the defendant, Donivan E. Adams, Warden of the West Virginia Penitentiary at Moundsville, West Virginia, to release him from the pentitentiary where he is now confined nnder a sentence of life imprisonment imposed by the Circuit Court of Preston County by its judgment pronounced June 22, 1957, in his trial upon an indictment for the crime of forgery.
