The plaintiff in error was prosecuted before a justice of the peace for violating the provisions of an act entitled “An act to prohibit the retailing of intoxicating drinks,” approved April 18th, 1851; and a judgment was rendered against him for twenty-five dollars. He appealed to the Circuit Court, where the appeal was dismissed, on the ground that no appeal is allowed in such a case. This presents the only question for our consideration.
