That is a suit by Lula B. Gass against Robert M. Tison, both in his individual capacity, as sole legatee and devisee under the will of his father, James W. Tison, deceased, and as independent executor of his will, to. recover, as sole heir of her deceased mother, Mrs. Gilley P. Tison, certain money and the value of certain personal property, the separate estate of said Gilley P. Tison, which it is alleged had been appropriated and used by the said James W. Tison, husband of the said Gilley P. Tison, and father also of plaintiff. It was alleged that said money and…
