David C. Beatty became obligated to the complainant about February 1st, 1905, in the sum of upwards of $300. The obliga*434tion was originally that of accommodation endorser on the commercial paper of a stranger to this suit. The obligation was renewed from time to time, until early in 1906, when the promissory note which represented it was protested for non-payment and the contingent liability which Mr. Beatty had theretofore been under' became fixed.
