Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court, entered in Clinton County) to review a determination of respondent Commissioner of Correctional Services which found that petitioner had violated certain prison disciplinary rules.

Based upon the contents of two misbehavior reports, petitioner was found guilty after a Superintendent’s hearing of engaging in violent conduct, refusing to obey a direct order and assault, in violation of prison disciplinary rules.
