This was the usual action by the owner of z’eal estate to restrain, by bill in equity, the further opez’ation and maizztenance of the defendant’s elevated z*ailroad, in fz’ont of his premises in East Thirty-fourth street, in the city of 27ew York, and for the recovery of the damages caused thereby. The cause was refez-red by stipulation, and the referee reported that the plaintiff was not entitled to z’estrain the operation and znaintenazice of the road but to judgment for damages only.
