— Appeal-from a judgment of the Supreme Court at Special Term (Shea, J.), entered March 17, 1982 in Clinton County, which sustained a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, and discharged petitioner. Convicted in Queens County Court of robbery in the third degree, petitioner was given an indeterminate sentence of imprisonment of one to seven years on November 20, 1975.
