This is an action of trespass, brought against the- defendant to recover the value of certain property taken and disposed of by him, which property belonged to the plaintiff.

The defendant justifies on the ground that he was the constable and collector of taxes for the town of St. Albans ; that, as such collector, he had in his hand certain tax-bills and warrants, in which taxes wore assessed against the plaintiff, which he was required by law to collect, and that he took the property in question and disposed of the same according to law…
