OPINION AND JUDGMENT

LATCHUM, District Judge.

Andrew J. Herhal (“Herhal”), a State prisoner, has petitioned this Court for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. He was permitted to proceed in forma pauperis.

In October 1966 Herhal was first convicted in the Delaware Superior Court by a jury of first degree murder of Sally Deputy. The Delaware Supreme Court in May, 1968 reversed his conviction and remanded the case for a new trial. Herhal v. State, 243 A.2d 703 (Del.Supr. 1968).
