The appellee sued the appellant in the Circuit Court •of Clay county in an action for damages for the alleged wrongful destruction by fire, negligently allowed to *585escape from appellant’s locomotive, of a lot of machinery of appellee. The cause was tried at the Fall term, 1891, of said Circuit Court before a jury and resulted in a verdict and judgment in favor of the plaintiff below for the sum of $4,783.33, from which judgment the defendant below appeals.
