Appeal from an order of the Supreme Court at Special Term, entered June 22, 1977 in Albany County, which granted defendant’s motion to dismiss the complaint on the ground that plaintiff lacked standing to maintain the action. Plaintiff is a regional off-track betting corporation, established by an act of the Legislature as a public *843benefit corporation (L 1973, ch 346, § 5).
