The plaintiff, claiming to be the owner of a certificate of indebtedness for $1,500 of the defendant, maturing on July 1, 1935, instituted this action to require the defendant to issue a new certificate in the plaintiff’s name and to account to him for the amount due thereon. The defendant contested the plaintiff’s title to the certificate and asserted that it was not hable to the plaintiff by reason of certain transactions soon to be considered.
