The judgment in favor of the plaintiff on the former trial was reversed, and a new trial granted. See Bentley v. Oldetyme Distillers, 69 N.D. 587, 289 N.W. 92.

On this trial a jury was waived; the court made findings of fact and conclusions of law favorable to the plaintiff; judgment for $10,000 was entered thereon, and the defendant appeals, setting forth twenty-three specifications of error.
