Appeal from an order of the Supreme Court, Erie County (Rose H. Sconiers, J.), entered May 19, 2009 in a personal injury action. The order, insofar as appealed from, denied defendants’ motion for summary judgment dismissing the complaint.
It is hereby ordered that the order so appealed from is unanimously affirmed without costs.
Memorandum: Plaintiff commenced this action seeking damages for injuries he sustained when he was bitten by a dog owned by defendants. Contrary to the contention of defendants, *1481Supreme Court properly denied their motion seeking summary judgment dismissing the complaint.…
