Appellant and plaintiff below,-as administrator of Ms decedent, filed this ordinary action in tbe Webster circuit court against appellee and defendant below, Kentucky Utilities Company, seeking to recover judgment against it for $40,600 alleged damages to tbe estate of plaintiff’s decedent, resulting from bis death and wbicb plaintiff in bis petition averred was produced by tbe negligence of defendant.''
