This casé is brought before us by writ of error to the circuit court of the first judicial circuit.

A summary possession proceeding was commenced in the district court of Honolulu on February 3, 1944, to recover possession of certain store premises. After judgment an appeal was taken to the circuit court of the first circuit for a trial de novo. The case having been set for trial for March 28, 1944, the parties plaintiff and defendant appeared by their respective counsel, whereupon the defendant confessed judgment and requested that the writ of possession be stayed until April 21, 1944.
