The prisoner is confined in the Detroit House of Correction under a conviction which purports to-be for conduct regarded by the police justice of Detroit as a breach of the peace. As the complaint and facts are not presented to us, we have no means of knowing whether they would come within the law or ordinances under which the? conviction was had, and for the purposes of this hearing we may assume that there is no difficulty on that matter, inasmuch as counsel had treated the case as raising no such question.
