The issue is whether the failure of a Judge to dispose of the business of the court promptly may *300constitute misconduct and, if it may, whether petitioner’s delays were serious enough to warrant his censure. The majority concedes that delay can constitute misconduct and that the Commission generally has jurisdiction of such cases. That is a hollow victory for the Commission, however, because the majority goes on to hold that it was without power to discipline petitioner in this case. The delays here, it holds, involved no more than a problem in the day-to-day operation of the courts.…
