MEMORANDUM OPINION AND ORDER

Secretary of Labor Elaine Chao brought this action against defendants Michael Lin-der, Joseph/Anthony & Associates, Inc. (“JAA”), Liz/Mar and Associates, Inc. (“Liz/Mar”), and various other pension and health and welfare plans, and their trustees, for violations of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq. 1 Specifically, plaintiff alleges fiduciary breaches in violation of various subsections of ERISA, including sections 404, 405, 406, 408, and 502. 2 Defendants Linder’s and JAA’s jointly…
