1. This was a suit for damages for personal injuries. The defendant admitted negligence, but contended that the plaintiff was not injured. In the reviewing court it is insisted that the verdict for $5,550 is excessive, and that the plaintiff in error is entitled to a new trial on account of certain newly discovered evidence. The plaintiff testified that the train was derailed while he was in the baggage-car, in which he had been invited to ride by the defendant, so as to accompany a son who was ill, and that he was struck by a trunk which was precipitated against him, and by other objects in…
