HOWE, Justice.
Plaintiffs Lloyd and Julia Owens appeal from a judgment entered on a jury verdict adverse to them. They seek vacation of the judgment and remand of the case for a new trial.
Plaintiffs owned a lot on which their son intended to build a house to be constructed by defendant, Lavon McBride. When plaintiffs’ son purchased property elsewhere instead, the defendant orally offered to build the house for the plaintiffs for the amount of the bid he had given their son, viz., $32,900, with the plaintiffs furnishing certain items of material and labor.
