This matter is before the Court on Defendants1 Plea in Bar and Motion for Summary Judgment to Winchester Homes’ Motion for Judgment. Winchester II arises out of the homebuilder’s claims against manufacturers and treaters of allegedly defective fire retardant treated plywood (“FRTP”).
