The defendant was indicted on March 7, 1983, for possession of marijuana. The offense occurred on September 22, 1982. On September 19, 1983, after entering a plea of guilty, the defendant was sentenced to three years in confinement followed by four years on probation upon the condition that he pay a $5,000 fine. On October 20, 1983, the trial court entered an order stating that “ALL of defendant’s sentence shall operate under the First Offender Act.” The defendant did not appeal from his sentence.
