Peek v. Pulaski Federal Savings & Loan Ass'n

Supreme Court of Arkansas

Decided May 28, 1985No. 85-7PublishedCited by 2 opinions

1Opinion of the Court

George Rose Smith, Justice.

The controlling question in this appeal is the validity of a local rule of the Pulaski Chancery Court by which a pending case may be dismissed without notice to the parties or attorneys if there has been no activity in the case for three years or more. The trial court upheld the local rule and refused to set aside a dismissal order. This appeal by the party whose case was dismissed comes to us under Rule 29(l)(c). We disagree with the chancellor’s refusal to set aside the dismissal in this instance.
