DEFENDANT was charged with murder by abortion, convicted of second degree murder, and sentenced to a term in the penitentiary. To reverse the judgment he prosecutes a writ of error.

Defendant introduced no testimony. At the close of the people's case, he moved for a directed verdict on the ground that the evidence was not sufficient to support a conviction. The court denied the motion. The assignments of error are directed to: 1.
