People v. Gentry

Appellate Court of Illinois

Decided May 14, 1956No. Gen. No. 10,057Published

1Opinion of the Court

JUDGE CARROLL

delivered the opinion of the court.

An information filed in the County Court of Mason county charged the defendant with being a vagabond.

The defendant filed a motion to quash the same on the ground that the county court lacks jurisdiction over vagrancy cases; that Par. 579, Chap. 38, Revised Statutes of Illinois, 1955, specifies that such cases shall be heard by a justice of the peace or a police magistrate, and, therefore, jurisdiction in such cases is limited to justices of the peace, police magistrates or the circuit court, which has original jurisdiction in all criminal cases.
