Beversing.

■ Appellant, Mat Foure, was tried in the Bockcastle circuit court under an indictment charging him with *64murder. The jury found him guilty and fixed his punishment at confinement in the penitentiary for life. Judgment of the court was duly entered and he prosecutes this appeal. This appellant is one of four defendants jointly indicted for the murder of Chester Mullins. The appeal of another of the defendants has heretofore been considered by this court in Gillis v.
