MEMORANDUM

TENNEY, District Judge.

Relator is presently incarcerated in Green Haven Prison, pursuant to a judgment of conviction rendered in the former Kings County Court after a trial by jury of the crime of Assault in the Third Degree, Assault in the Second Degree, and Possession of a Dangerous Weapon as a felony. He was sentenced on September 27, 1960 as a third felony offender to a term of 10 to 14 years on the Possession Count to run concurrently with a 2i/2 to 5 year term on the conviction for Second Degree Assault, and received a suspended sentence on the Assault. in the Third Degree…
