*1173In an action for the return of a down payment made pursuant to a contract for the sale of real property, the plaintiffs appeal, as limited by their brief, from so much of an order of the Supreme Court, Nassau County (Iannacci, J.), dated June 9, 2009, as denied their cross motion for summary judgment on the complaint.
Ordered that the order is affirmed insofar as appealed from, with costs.
