Respondent is before the court on two petitions arising out of the same incident. The first of these charges the respondent with being a juvenile delinquent based upon alleged possession of a 5 millimeter air-gun in violation of section 265.05 of the Penal Law. The second petition charges the respondent with being a juvenile delinquent based upon reckless endangerment in the second degree in violation of section 120.20 of the Penal Law.
