Appeal from a judgment of the Supreme Court (Lynch, J.), entered October 13, 2010 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of the Department of Correctional Services calculating petitioner’s prison sentence.
Petitioner was convicted of robbery in the first degree in November 1989 and sentenced to a prison term of 2 to 6 years. He was thereafter released to parole in February 1991 and, on November 1, 1993, arrested on new charges. Petitioner was found guilty of, among other things, murder in the second…
