Catón, J.

The bill in this suit shows that the complainant and defendant, as copartners, were engaged in the distillery business in Pennsylvania. That, in pursuance of their agreement of copartnership, the complainant kept the books of the concern, made the necessary advances, received and disposed of the products of the distillery, and that the defendant did the distilling, for which he was to receive a certain stipulated price per gallon.
