The respondent commenced an action in the circuit court for the county of Union, against the appellant, upon a certain promissory note, executed by the appellant on the 27th day of August, 1879, for the sum of $159.50, payable to the order of one II. R. Garner,, one day after date, with interest thereon at the rate of one per cent, per month ; and alleged that he was the owner and holder thereof; and that the same was due and wholly unpaid.
