Plaintiff brought this action pursuant to Title VII of the Civil Rights Act of 1964, 42 U.S.C. §§ 2000e et seq., alleging that he was terminated from his employment because of racial discrimination. On December 10, 1991, Magistrate Judge Grubin issued an oral Report and Recommendation (“R & R”) in which she recommended that the Court dismiss Plaintiffs complaint under Fed.R.Civ.P. 37(b)(2)(C).
