On July 28, 1914, the First National Bank of Waco brought suit in said court against R. H. Kimsey, W. J. Dunken, Charles L. Sanger, and Frank McNeese. alleging that on the 24th of March, 1913, said parties made, executed, and delivered to it their certain promissory note for $4,327.90, due on demand, bearing 8 per cent, interest from date, and providing for 10 per cent attorney’s fees, upon which there were certain credits, amounting to $3,775, praying for judgment for its debt, interest, and attorney’s fees.
